We are committed to protecting your privacy and the confidentiality of the personal information you provide.

We comply with the requirements of the Privacy Act 1988 (Cth). It sets out standards on the collection, use, disclosure and handling of personal information.

Our Privacy Policy explains how we collect, use, disclose and handle your personal information, in accordance with the Privacy Act 1988 (Cth).


Personal information
Personal information is information or opinion that can be used to identify an individual. The type of personal information we collect will depend on the product or service you request. It may include:
• name
• age
• occupation
• contact details
• gender
• previous insurance and claims history
• details of assets (such as properties owned).

In most cases, and wherever possible, we will collect this personal information either directly from you or from your insurance adviser.


Why we collect personal information
We collect personal information about you for the purpose of providing you with insurance products and services.

This includes information necessary to: assess applications for insurance, underwrite and administer insurance policies, handle and manage claims, and practice risk management.

We may also collect personal information so that we can provide you with relevant marketing material about our products and services.

If you do not provide us with the required information we may not be able to provide you with our products or services. In some cases, you may also be in breach of your duty of disclosure under the Insurance Contracts Act 1984 (Cth).


Disclosure of personal information to third parties
We may disclose some or all of your personal information to:
• insurers and other insurance providers
• your insurance intermediary (the company or individual through which you purchased a product or service from ATC or otherwise dealt with us)
• the co-insured/s named on your policy
• third parties appointed by ATC or the insurer to assist us in supplying products and services
• other companies in the event of a corporate sale, merger, reorganisation, dissolution or similar event.

Some of these third parties may be located overseas. We may also disclose your personal information as permitted or required by law.

ATC does not sell, trade, or rent personal information or client lists.

To effectively assess and manage claims we may also disclose personal information to (and/or collect additional personal information from) other third parties, including the following:
• claims investigators including loss assessors and adjustors
• lawyers
• claims management companies
• repairers and suppliers retained by us to supply goods and services
• medical practitioners and health workers
• federal or state regulatory authorities, including Medicare Australia and Centrelink.

By providing us with your personal information, you consent to ATC disclosing your personal information to third parties when the need arises as described above.

When we provide you with personal information, you must ensure that you and your representatives (including your employees, agents and contractors) only use it for the purpose we have agreed to and in a manner consistent with the Privacy Act 1988 (Cth).


Personal information about other people
If you have provided us with personal information about other people, we have relied upon you to have advised them that you will or may disclose their personal information to us for the purposes described above and to have obtained their consent to do. If you have not done this, you must tell us before you provide us with their personal information.

When handling claims, we may also collect personal information about individuals who have made claims against clients of ATC in order to effectively assess and handle the claim in the best interests of all parties.


Personal information about you received from a third party
When we have received personal information about you from a third party, we have relied upon them to have informed you that they will or may provide us with your personal information and to have obtained your consent to do so.

Our website
If you download a form (like a claim form or an application for insurance) from our website and complete and return it to us, we will only collect the personal information you provide on the form.

If you choose to contact us via our website, we will only collect your email address (or other contact details) so that we can respond to your enquiry. Otherwise your visit to our website is anonymous.


Security of your personal information
We store your personal information either electronically or in hard copy or both. We adopt the measures expected to ensure personal information is secure and protected from unauthorised access, use, modification or disclosure.

Checking your personal information
We will disclose to you the personal information we hold about you following a written request from you, except in circumstances where access may be denied under the Privacy Act 1988 (Cth). We will also correct any personal information about you that we agree is incorrect or not up to date.
